On March 27, 2013, 12:30-1:30pm EDT, Olshan will present the webinar Competitor Advertising Challenges: Lanham Act vs. NAD.  CLE credit will be available for this complimentary program which will offer a practical analysis of alternative forums for addressing competitor advertising claims.

This webinar will examine the legal and strategic considerations of initiating a challenge before the National Advertising Division (NAD) of the Council of Better Business Bureaus versus filing a Lanham Act case in federal court.  Subjects to be discussed include:

  • Burden of proof
  • Costs
  • Availability of counterclaims
  • Discovery
  • Speed of Resolution
  • Damages and other remedies.

Olshan speakers will be Andrew B. Lustigman, the Chair of Olshan’s Advertising, Marketing & Promotions practice group.  He represents marketers, advertisers, and traditional and digital agencies and suppliers in connection with the legal aspects of their advertising and promotional marketing businesses.  Mr. Lustigman has significant experience handling NAD challenges and federal court Lanham Act matters.
