After Trial, Olshan Client Wins Court Order Under RPL Section 881 to Get Access for South Bronx Charter School

Olshan was successful in obtaining a ruling by New York Supreme Court, County of Bronx, Judge Donald A Miles for client Civic Builders granting a license to access its neighbor’s property at 763 Concourse Village West, Bronx, NY for a term of at least 16 months in order to begin construction on South Bronx Classical IV Charter School, located at 757 Concourse Village West, Bronx, NY. After the neighbor refused to negotiate construction terms with Civic Builders pursuant to RPAPL§ 881, the Court was required to render a decision, making a rare falsus in uno ruling against the neighbor’s sole witness. Groundbreaking on the 54,000 square foot school, which will serve grades Kindergarten through eighth grade, began on July 18th.
