Olshan Wins Appeal for USPA as Court Vacates Contempt Claims
The New York Law Journal (subscription required), U.S. News & World Report, Reuters and numerous other national media outlets reported that the 2nd U.S. Circuit Court of Appeals in Manhattan ruled that Olshan client United States Polo Association cannot be held in contempt for selling sunglasses with the "double horsemen mark," reversing a 2012 ruling by a lower-court judge stating it was wrong to conclude that banning the use of a Double Horsemen trademark on fragrance products meant that it cannot be used on other products like sunglasses. The dispute between the USPA and Ralph Lauren has gone on for more than three decades and the validity of USPA's Double Horsemen Marks has been litigated and upheld repeatedly. This was the third case in the last eight months in which Olshan has won dismissal of claims filed by Ralph Lauren against USPA. Kyle Bisceglie and Steven Gursky are representing the USPA.
