Law360 Quotes Lustigman on FTC Data Broker Report
Law360 covered (subscription required) the FTC’s recent issuing of its extensive report, “Data Brokers: A Call for Transparency and Accountability.” In the report, which is considered to be the most detailed on the subject to date, the FTC pushes data brokers to make their practices more transparent to consumers. The article quotes Olshan Partner Andrew Lustigman, who says that “the level and specificity of detail provided in terms of the number of data collection points, the use of the data and the types of data profiling was much greater than prior reports.” Previously, the FTC has pursued only credit-reporting agencies for data usage under the under the Fair Credit Reporting Act, but the report signals that the FTC will start to target data brokerage companies, as well, under Section 5 of the FTC Act. The report proposes specific legislation as well as best practices.
