Lustigman Quoted in NYPost and Law360 On Lawsuit Filed Against Twitter, Facebook & Google

Olshan Advertising, Marketing & Promotions Practice Group Leader, Andrew Lustigman, was quoted in New York Post and Law360 where he addressed the lawsuit in a Michigan federal court against Twitter, Facebook and Google by family members of three victims in the mass shooting at the Pulse nightclub in Orlando Fl.  The members claimed the companies’ social media tools facilitated ISIS group by radicalizing the shooter Omar Mateen. Lustigman stated, “I think that the plaintiffs will have a very difficult time overcoming Section 230 of the Communications Decency Act, which immunizes websites that merely provide an outlet for another party to provide its content.” He also referred to a Northern District of California court ruling made last month in the case Fields v. Twitter, where Twitter could not be held accountable for providing social media accounts to members of ISIS. Lustigman concluded by saying that the viability of the claim could be different if the defendants have been involved with the creation of such messages.
