Olshan Litigators Win Summary Judgment

The New York Law Journal featured the Anthracite decision as a “Decision of Interest”. Thomas J. Fleming, Kyle C. Bisceglie and Peter M. Sartorius defeated Anthracite’s motion for summary judgment for a firm client against mezzanine lender Anthracite. The decision by Judge Laura Taylor Swain of the Southern District of New York confirmed Olshan’s argument that fraudulent inducement, standing and illegality are legally viable defenses to “absolute and unconditional” guarantees.
