Shaffer Quoted in Law360
Law360 quoted Olshan partner Scott Shaffer in the October 27th edition of its Privacy reporter. Law360 sought out Shaffer’s view on two recent Third Circuit Court of Appeals rulings concerning the Telephone Consumer Protection Act. The Third Circuit reinstated a $14 million lawsuit against Yahoo!’s text messaging protocol, citing the FCC’s broad and controversial definition of “autodialer”; in a separate case, the Third Circuit allowed a man to assert TCPA violations for a call placed to his roommate’s telephone, a type of claim that was not previously permitted. According to Shaffer, the decisions “will broaden the potential universe of TCPA plaintiffs and encourage enterprising class action attorneys to come up with new theories of liability in search of the TCPA's $500-per-call bounty.”
