Olshan Secures Jury Trial Win For Broker Dealer in Georgia Federal Court
In April 2024, an Olshan trial team secured a complete victory for client FT Global Capital, Inc. (“FT Global”) on its claims for breach of contract and attorneys' fees. FT Global is a registered broker dealer that provides placement agent services to foreign issuers seeking to raise capital in the US markets. In 2021, it sued Future Fintech Group, Inc. for failing to pay the fees owed under a “tail clause” in FT Global’s engagement agreement, in a case titled FT Global Capital, Inc. v. Future Fintech Group, Inc. Olshan defeated a motion for summary judgment motion and then achieved a total victory in a four-day trial federal court in Atlanta, Georgia. The eight-member jury returned a unanimous verdict in favor of FT Global, awarding it nearly $7.9 million in damages, plus $2.7 million in prejudgment interest and attorneys' fees. Olshan litigation partner Thomas J. Fleming and counsel Jacqueline Y. Ma represented FT Global in this matter, which Law360 reported on here.
